New Haven Court Clears Bandsmen

Band manager Peter H. Strauss '54 and band member Edward K. L. Upton '53 1G had their cases dismissed yesterday morning in New Haven District Court.

But Strauss--who was arrested when the Harvard band stormed New Haven early Saturday morning on the way to the Columbia game--paid a $15 fine for damage to a cruiser.

"They admitted that they knew that we didn't do it, but they charged us for it, anyway," Strauss said. "So we paid."

Strauss and Upton both pleaded not guilty to the charge of disturbing the peace, and since there were no witnesses in court, both men were acquitted. But Strauss was placed on probationary status. If he is arrested between now and Dec. 3, he will be either fined or put in jail.

Strauss and Upton were arrested at 3 a.m. Saturday morning as the band stopped off an awakened New Haven on its way to New York City. Both men were booked and charged with disturbing the peace. They were let off on bail at that time.
