Below are given the articles of agreement between Harvard and the University of Pennsylvania with regard to the two football games on Thanksgiving Days of '93 and '94. The challenge for these games came from Pennsylvania sometime ago and was accepted by Harvard. These articles of agreement are the final settlement of the matter.
CAMBRIDGE, Mass., April 28,1893.
We, the undersigned, representing the football associations of Harvard and the University of Pennsylvania respectively, do hereby agree to play two games of football, the first on Thanksgiving Day, 1893, at Cambridge, Mass., and the second on Thanksgiving Day, 1894, at Philadelphia, Pa.
In each year a meeting shall be held between the captains of the two elevens, on or before Oct. 15th, at which a referee and an umpire shall be selected, the playing rules shall be decided upon, and all other matters not covered by this agreement shall be settled.
The composition of the teams shall be determined by the following rules:
RULE 1. AMATEURS.No student shall be allowed to represent Harvard University or the University of Pennsylvania in any public athletic contest, either individually or as a member of any team, who either before or since entering the University shall have engaged for money in any athletic competition, whether for a stake, or a money prize, or a share of the entrance fees or admission money; or who shall have taught or engaged in any athletic exercise or sport as a means of a livelihood; or who shall at any time have received for taking part in any athletic sport or contest or any pecuniary gain or emolument whatever, direct or indirect, with the single exception that he way have received from the college organization, or from any permanent amateur association of which he was at the amount by which the expenses necessarily incurred by him in representing his organization in athletic contests exceeded his ordinary expenses.
RULEII. Bona Fide Students.No one shall be allowed to represent Harvard University of Pennsylvania in any public contest, either individually or as a member of any team, unless he is, and intends to be throughout a college year, a bona fide member of the University, taking a full year's work.
A student who is dropped for neglect of his studies into a lower class shall be debarred from taking part in intercollegiate contests until the end of the next academic year, or until be is permitted by the Faculty to rejoin his class.
No one hereafter entering the University, who is not a regular student in the college or scientific school, and no regular student in either of these departments, who has ever played in an intercollegiate contest upon a Class or University team of any other college, shall play upon a Harvard or University of Pennsylvania team until he has resided one academic year at the University and passed the annual examinations upon a full year's work.
RULE III. Time Limit.No student, whether he has represented one or more colleges shall take part in the intercollegiate contests for more than four years; and this period shall begin with the year in which, as a player upon a University team, he first represented any college. In reckoning the four years, the year of probation mentioned in Rule II shall be excluded, and also any year lost to a student by illness. But this rule shall not, during the calendar year 1893. disqualify any one who would be eligible under pre existing rules.
RULE IV.Announcement of names of Players.
Each captain shall send to the captain of the opposing team a complete list of his players and substitutes, with a statement that he believes them to be bona fide students and amateurs, at least twenty-five days before the date of the contest in which they are to take part, No one shall be included in such list, who has not declared in writing his eligibility within the preceding rules in the presence of a member of the graduate committee. No one whose name is not on such a list shall be allowed to play in an intercollegiate game except by the consent of the captain of the opposing team. All objections to the eligibility of the persons whose names appear upon the said lists shall be considered as waived unless taken at least twenty days before the contest in which they are to take part.
RULE. Arbitration.In the event of any difficulty arising in the interpretation or application of the foregoing rules relating to eligibility, two representatives, one from each of the two competing universities shall meet and endeavor to adjust the difficulty. In case they cannot agree they shall choose a third person, not a member or graduate of either University, to act with them. The decision of the majority of these three persons shall be final. In case of an objection to eligibility under Rules II or III, it shall be the duty of the Arbitration Committee to meet forthwith for the consideration of the objection; and they shall make a final decision with respect to it, and notify both captains thereof, at least fourteen days before the contest.
